Our General Terms and Conditions of Sale conform to the provisions of Decree No. 94-490 of 15th June 1994 pursuant to Article 31 of Law No. 92-645 of 13th July 1992 establishing the conditions for conducting business activities relating to the organisation and sale of travel and holidays. In order to comply with legal provisions, we are reproducing Articles 95 to 103 of that Decree.

Art. 95 - Subject to the exclusions mentioned in the second paragraph (a and b) of article 14 of the aforementioned law of July 13 1992, appropriate documents meeting the requirements set out in the present section must be provided for all offers and sales of travel services or holidays.
In the event of air tickets or scheduled travel tickets being sold not accompanied by services related to that travel, the vendor shall deliver to the purchaser one or more tickets for the whole journey issued by the carrier or under its responsibility. In the case of on-demand carriage, the name and address of the carrier on whose behalf the tickets are issued must be mentioned.
Separate invoicing of the various elements of one and the same holiday package shall not release the vendor from the obligations placed on him under this section.
Art. 96 - Prior to the conclusion of the contract and on the basis of a written document bearing its company name, address and an indication of its current administrative authorisation, the vendor must inform the consumer of the prices, dates and other aspects of the services provided in the travel or holiday such as:
1. Destination, methods, characteristics and categories of transport used.
2. Type of accommodation, location, standard of comfort and principal characteristics, type approval and tourist classification corresponding to the usages and regulations of the host country.
3. Meals provided.
4. Description of the itinerary in the case of a tour.
5. Administrative and health formalities to be carried out, particularly in relation to crossing borders as well as timings.
6. Visits, excursions and other services included in the package or available at an additional cost.
7. The maximum or minimum size of the group enabling the journey or holiday to go ahead and, if the journey or holiday is subject to a minimum number of participants, the latest date for informing the consumer if the journey or holiday is to be cancelled; that date may not be less than 21 days before departure.
8. The amount or percentage of the price to be paid by way of deposit on conclusion of the contract and the timetable for paying the balance;
9. The price review procedures as provided in the contract pursuant to Article 100 of this Decree.
10. Cancellation conditions of a contractual nature.
11. Cancellation conditions specified in Articles 101, 102 and 103, to follow.
12. Details of the risks covered and amount of cover taken out under the insurance policy covering the consequences of the travel agent’s professional liability and the public liability of non-profit-making associations and organisations and local tourist organisations.
13. Information on taking out an optional insurance policy covering the consequences of certain circumstances of cancellation or assistance contract covering certain specific risks, in particular the cost of repatriation in the event of an accident or illness.
Art. 97 - Prior information given to the consumer shall be binding on the vendor unless within it the vendor expressly reserves the right to change certain elements. In such case the vendor must clearly indicate how that change takes place and which elements it affects.
In any event, changes made to such prior information must be given to the consumer in writing before the contract is concluded.
Art. 98 - The contract concluded between the vendor and the purchaser must be in writing, produced in duplicate, one copy of which is to be given to the purchaser, and signed by both parties. It must contain the following clauses:
1. The name and address of the vendor, its guarantor and insurance company as well as the name and address of the organiser.
2. The destination or destinations of the journey and, in the event of a split holiday, the various periods and their dates.
3. The types, characteristics and categories of transport used, departure and return dates, times and venues.
4. Type of accommodation, location, standard of comfort and principal characteristics, tourist classification in accordance with the usages and regulations of the host country.
5. Number of meals provided.
6. Itinerary in the case of a tour.
7. Visits, excursions and other services included in the total price of the travel or holiday.
8. The total price of the invoiced services and an indication of any review of that invoicing in accordance with the provisions of Article 100 below.
9. An indication, if appropriate, of any fees or charges relating to certain services such as landing, boarding or disembarkation charges in ports and airports, tourist taxes if these are not included in the price of the service(s) supplied.
10. The timetable and method of paying the price; in any event the last payment made by the purchaser may not be less than 30% of the price of the travel or holiday and must be paid on delivery of the documents enabling the travel or holiday to be undertaken.
11. Any particular conditions requested by the purchaser and accepted by the vendor.
12. The procedures by which the purchaser may make a claim on the vendor for non-performance or poor performance of the contract, which claim must be sent as quickly as possible, by registered letter with acknowledgement of receipt, to the vendor and possibly reported in writing to the organiser of the travel and the provider of the services concerned.
13. The last date for informing the purchaser of the cancellation of the travel or holiday by the vendor where the travel or holiday is dependent on a minimum number of participants, in accordance with the provisions of para. 7 of Article 96 above;
14. Cancellation conditions of a contractual nature.
15. Cancellation conditions provided in Articles 101, 102 and 103, below.
16. Details about the risks covered and the amount of cover of the insurance policy covering the consequences of the vendor’s professional liability;
17. Information about the insurance policy taken out by the purchaser covering the consequences of certain circumstances of cancellation (policy number and name of insurance company) as well as the assistance policy covering certain particular risks, in particular the cost of repatriation in the event of an accident or sickness; in such case, the vendor must give the purchaser a document specifying at least the risks covered and those excluded;
18. The final date for informing the vendor in the event of the purchaser transferring the contract;
19. A written undertaking to provide the purchaser with the following information at least ten days before the scheduled departure date:
- the name, address and telephone number of the vendor’s local representative or, failing that, the names, addresses and telephone numbers of local organisations able to help the consumer in the event of difficulty or, failing that, a call number to contact the vendor in an emergency;
- for minors travelling and holidaying abroad, a telephone number and address for making direct contact with the child or the responsible person at the holiday venue.
Art. 99 - The purchaser may transfer his contract to a transferee who fulfils the same conditions as himself in respect of taking the travel or holiday as long as the contract has not yet come into force.
Unless there is a stipulation more favourable to the transferor, the latter must inform the vendor of his decision by registered letter with acknowledgement of receipt at least seven days before the start of travel. In the case of a cruise, that time limit is increased to two weeks.
Under no circumstances shall such transfer be subject to the vendor’s prior authorisation.
Art. 100 - If the contract contains the express possibility of a price review, within the limits provided in Article 19 of the above mentioned Law of 13th July 1992, it must state the exact method of calculation of upward and downward price variations, and in particular the amount of transport expenses and related taxes, the currency or currencies which may have an impact on the price of the travel or holiday, the portion of the price to which the variation applies and the exchange rate of the currency or currencies used as a reference when establishing the price appearing in the contract.
Art. 101 - If the vendor is compelled to change any of the essential aspects of the contract such as a significant price increase, before the purchaser departs, the purchaser may, without prejudice to claiming reparation for any loss suffered, and after having been informed by the vendor by registered letter with acknowledgement of receipt:
? either cancel his contract and secure an immediate refund of any monies paid, without penalty;
? or accept the change or replacement travel offered by the vendor; an endorsement to the contract specifying those changes shall then be signed by the parties; any price reduction shall be deducted from any monies still payable by the purchaser and if the payment already made by the latter exceeds the price of the amended service, any over-payment must be refunded to him before his date of departure.
Art. 102 - In the circumstance provided in Article 21 of the above mentioned Law of 13th July 1992, if the vendor cancels the travel or holiday before the purchaser departs, he must inform the purchaser by registered letter with acknowledgement of receipt; without prejudice to claiming reparation for any loss suffered, the purchaser shall receive an immediate refund of any monies paid from the vendor without penalty; in such case, the purchaser shall receive compensation of at least the penalty he would have incurred if he had made the cancellation on that date.
The provisions of this article shall not impede the conclusion of an amicable agreement whereby the purchaser accepts a replacement journey or holiday offered by the vendor.
Art. 103 - If, after the purchaser’s departure, the vendor is unable to provide a preponderant part of the services provided in the contract, representing a not insignificant percentage of the price paid by the purchaser, the vendor must immediately take the following action without prejudice to any claim for reparation of any loss suffered:
? either offer services to replace the initial services, bearing any additional cost and, if the services accepted by the purchaser are of inferior quality, the vendor must refund the price difference as soon as he returns;
? or, if he cannot offer any replacement service or if they are rejected by the purchaser on valid grounds, provide the purchaser, at no additional cost, travel tickets so that he can return to the point of departure or to another venue accepted by both parties under conditions deemed to be equivalent.
SPECIFIC SALES CONDITIONS - SUMMER 2009
Particular terms and conditions of sale
ARTICLE 1 - REGISTRATION / BOOKING / PAYMENT
1.1 - Registration and booking terms and conditions Every registration must be accompanied by a payment including:
• The administration charge:
- for online bookings (PIERRE ET VACANCES/MAEVA): €25 per booking for any stay of 5 nights or more, €15 per booking for any stay of 4 nights or less);
- for other bookings (PIERRE ET VACANCES/MAEVA): an administration charge of €30 per booking for any stay of 5 nights or more, €20 per booking for any stay of 7 nights or less; NB: you will not be asked for any administrative fees for bookings made in Adagio City Aparthotels and LATITUDES HOTELS.
• A deposit corresponding to:
- 25% of the overall price of your booking and any additional services, whether included or not, in particular meals, children’s clubs, sporting activities, etc.
- 100% of the overall price of any transport services (flights, transfer, car hire, rail travel),
- 100% of the value of insurance premiums if you want to take out the insurance.
1.2 - Premium facility
- From the date of payment of fees and advances up to the 31st day (for a stay in a tourist residence) or the 15th day (for a stay in a hotel or hotel apartment) inclusive preceding your stay, you will benefit from a premium facility. If you exercise it, the deposit paid will be refunded to you but the above mentioned administration charge will be retained by P&V. The total amount of insurance is payable upon reservation and cannot be reimbursed.
- We would like to draw your attention to the fact that activities connected with the organisation and sale of travel or accommodation services on a given date or for a specified period are not subject to the right-to-cancel period applicable to distance sales.
1.3 - Payment of the balance
The full price of your booking plus any additional services is payable:
- 30 days before the start of your holiday in a tourist residence,
- 14 days before the start of your holiday in a hotel or hotel apartment,
- or in all cases immediately for any last minute reservations.
The full price must have been paid, before you are sent your travel documents (including your rental contract or accommodation slip, description of the location, plane tickets, etc.) by P&V. If you have not settled the account within the specified timeframe and you have not used your premium facility, P&V reserves the possibility to consider the sale as definitive from either the 30th day or the 14th day before your stay depending on your reservation and may apply the cancellation conditions drawn up for this event and defined hereafter as a consequence. Your commitment therefore become final on payment of the balance before the 30th or 14th day of your stay or, in the event of non-payment of the balance and no use of the premium facility on your behalf, from the 30th or 14th day preceding your stay. P&V's commitment becomes final before the 30th or 14th day preceding your stay, from the sending of your reservation confirmation.
1.4 - Methods of payment
For PIERRE ET VACANCES / MAEVA
• For all bookings up to 31 days before your holiday, you may pay 100% of the cost of your holiday by any method of payment: bank card (*), cheque (**), or bank transfer (***)
• For all bookings between 30 and 15 days prior to your holiday, you may:
- pay 100% of the cost of your holiday by bank card (*)
- or pay 25% of the cost of the holiday as a deposit by bank card (*) and the balance within 5 days by cheque (**) or bank transfer (***).
For all bookings between 14 and 8 days prior to your holiday, you may:
- pay 100% of the cost of your holiday by bank card (*)
- or pay 50% of the cost of the holiday as a deposit by bank card (*) and the balance within 5 days by cheque (**) or bank transfer (***).
• For all bookings made less than 7 days prior to the beginning of the holiday, you must pay 100% of the cost of your holiday by bank card only (*).
For LATITUDES HOTELS
Payments may be made by bank card (*), cheque (**) or bank transfer (***). For any reservation less than 15 days before the start of the stay, payment is only possible by bank card.

ARTICLE 2 - PRICES
2.1 - Accommodation
Our prices include all taxes and include the provision of the accommodation, including charges (water, electricity, heating) but excluding tourist tax, payable on site, pet supplements, optional insurance premiums and administration charges, payable on booking where applicable. We would remind you that accommodation provided for a specific number of occupants on booking may not be occupied by a larger number of people.
For MAEVA: It is reminded that young children are considered as occupying a complete space. Some of our balconies, loggias, terraces and gardens are not equipped with tables and chairs.
2.2 - Optional services
Our accommodation rates do not include optional extra services on
offer in the catalogue, on our website or on site.
2.3 – Sunshine guarantee (valid only for PIERRE ET VACANCES Atlantic and Channel coast sites)
2.3.1 – Conditions of eligibility
Our accommodation rates include a sunshine guarantee, valid only during the Summer 2009 Season (from 04/04/09 to 14/11/09, except for the period from 05/07/09 to 29/08/09), whereby you may ask to change the place or dates of your stay, provided that the following cumulative conditions are met:
1) The initial booking for your stay must have been made directly with PIERRE ET VACANCES (via the www.pierreetvacances.com website, at one of the Pierre & Vacances shops, directly at one of the Pierre & Vacances residences, or with the Bookings Centre on 0891 70 1000). This excludes bookings not made directly with PIERRE ET VACANCES, in particular with Tours Operators.
2) The booking must be for a stay at a “Pierre & Vacances” site located on the Atlantic or Channel coast
3) The stay must be for at least 7 consecutive nights
4) The stay you have booked must not be during the months of July and August (i.e. not in the period between 05/07/09 and 30/08/09)
2.3.2 – Conditions governing the exercise of your right
Subject to the conditions set out under point 2.4.1. above, you may apply to change the place or dates of your stay under the following conditions:
1) The www.lachainemeteo.fr website must be forecasting at least 2 days of rain during the stay you have booked
2) You request for a change may only be made to the Bookings Centre on 0891 70 1000, or the residence at which you made your booking
3) Your request for a change must be made 5 to 3 days prior to the stay you have booked
4) Your request for a change must be specific: only one application per booked stay
2.3.3 – Conditions governing the new stay
A new booking is possible only for the 2009 Summer Season (from 04/04/09 to 14/11/09, except for the period from 05/07/09 to 29/08/09), and for a stay of at least the same duration as the stay you are asking to change, subject to availability.
The change of destination can be for any of the “Pierre & Vacances” seaside resorts, including those on the Mediterranean, subject to availability;
If the new stay is more expensive that the stay you are asking to change, you will have to pay the additional cost; if the new stay is less expensive, you will be reimbursed in the form of credit.
2.4 - Reduction (Valid only for PIERRE ET VACANCES / MAEVA)
- The reductions mentioned in the catalogue are only applicable to accommodation and therefore all other services (meals, sport and leisure activities, etc.) are excluded.
ARTICLE 3 - TOURIST TAX
Tourist tax, collected on behalf of the local authorities, is not included in our prices. It is approximately €1 per person per day and should be paid on site.
ARTICLE 4 - ALTERATION / CANCELLATION OF HOLIDAY BY THE CUSTOMER
4.1 - Alteration
4.1.1 - Accommodation
a) For LATITUDES HOTELS
For any hotel stay of three nights or less, we will endeavour to accept your requests to change the date, type of accommodation or holiday venue as far as possible subject to availability. These alterations may be made at no additional cost. Any request to shorten your stay or reduce the number of apartments booked will be regarded by LATITUDES HOTELS as a partial cancellation and will be subject to the cancellation procedures set out in point 4.2 below.
For any hotel stay of three nights or more, we will also endeavour to accept your requests to change the date, type of accommodation or holiday venue as far as possible subject to availability. If the value of your booking (excluding optional services) after the alteration is lower than the value of the booking before the alteration, we will retain €10 as a charge for this alteration. Any request to shorten your stay or reduce the number of apartments booked will be regarded by LATITUDES HOTELS as a partial cancellation and will be subject to the cancellation procedures set out in point 4.2 below.
b) For MAEVA / PIERRE ET VACANCES
Change of type We will endeavour to accept your requests to change the type of apartment as far as possible subject to availability. If the value of your booking (excluding optional services) after the alteration is lower than the value of the booking before the alteration, we will retain €10 as a charge for this alteration. Change of holiday date or place We will endeavour to accept your requests to change the date or holiday venue as far as possible subject to availability. However, please note that this type of change causes variable costs for P&V depending on the date on which you make your request.
This means that for all changes of holiday date or place, we will apply the following charges:
- if your request to change is made within 30 days prior to your arrival and if the cost of the new booking is less than the cost of the initial booking: 10 euros.
- if your request to change is made between 30 and 15 days prior to your arrival: 15% *
- if your request to change is made between 14 and 8 days prior to your arrival: 30% *
- if your request to change is made between 7 and 4 days prior to your arrival: 50% *
* of the total cost of the accommodation.
No request to change will be taken into account if it is received by P&V three days or less prior to your arrival.
NB:
- any request to extend the length of your holiday will be accepted by P&V without any additional charge except for your transport services.
- any request to reduce the length of your holiday will be deemed by P&V to be a partial cancellation and will be subject to the cancellation terms referred to in 4.2 hereafter.
4.1.2 - Optional services
We will endeavour to accept your requests to change the optional services as far as possible subject to availability. If the value of your optional service after the alteration is lower than the value of the optional service before the alteration, we will retain €10 as a charge for this alteration. With respect to transport, whatever the means of transport and date, changes to outward or return travel dates are either impossible or will incur variable costs for the passenger depending on the date upon which the change occurs and according to the terms and conditions mentioned at the time of booking.
LATITUDES HOTELS
For all stays of three nights or less, we will endeavour whenever possible to accept your requests for change of optional services subject to availability. These changes may be made without any surcharge. For all stays in hotels of over three nights, we will also endeavour whenever possible to accept your requests for changes in optional services subject to availability. If the amount of your optional service after the changes proves to be less than the amount of the optional service before the changes, we will retain €10 as a charge for these changes.
4.2 - Cancellation (total or partial)
In the event of cancellation you must notify us either by post to the following address PIERRE ET VACANCES service annulations BP291 75921 PARIS CEDEX 19, or by fax 33 ( 01) 58 21 50 97 for the attention of ‘service annulations’, or by e-mail to the following address: annulation.adv@pierre-vacances.fr.
The date of cancellation is determined by the date of receipt of notification.
4.2.1 - Accommodation
a) Holiday in a Residence (PIERRE ET VACANCES / MAEVA / Deauville Residence)
Regardless of the date on which the booking is cancelled, we retain the administration charge initially paid, if appropriate, and the amount of any insurance premiums paid.
In addition, from the 30th day prior to your stay, we will retain the following indemnities, depending on the type of holiday you have chosen:
- if you request a cancellation between 30 and 15 days prior to your arrival 25% *
- if you request a cancellation between 14 and 8 days prior to your arrival 50% *
- if you request a cancellation 7 days or less prior to your arrival 100% *
* of the total cost of the accommodation.
b) Holiday in a hotel or hotel apartment (PIERRE ET VACANCES /
MAEVA / LATITUDES HOTELS (except as specified at c) below)
Regardless of the date on which the booking is cancelled, we retain the amount of any insurance premiums paid. In addition, for any stay lasting more than 3 nights, if you inform us after the 14th day prior to your stay and before 4 pm on the day of your arrival (PIERRE ET VACANCES and MAEVA sites), or before 6 pm on the day before your arrival (LATITUDES HOTELS sites), we will retain the following indemnities, depending on the type of holiday you have chosen:
For a stay of 4 to 6 nights, payment for one night*,
For a stay of 7 days or more, payment for two nights*
* the price of a “night” is the total cost of the stay divided by the number of nights booked.
Half-board or full board holiday: the charges will be the same as above.
c) Special case for LATITUDES HOTELS: holiday in a hotel or hotel
apartment for the Pont Royal, Cap Esterel and Valescure hotels during the months of July and August 2009
Regardless of the date on which the booking is cancelled, we retain the amount of any insurance premiums paid.
In addition, if you inform us after the 14th day prior to your stay, we retain the following indemnities:
- if you request a cancellation 14 to 8 days prior to your arrival: 50 %*
- if you request a cancellation 7 days or less prior to your arrival: 100 %*
* of the total amount payable for the accommodation.
4.2.2 - Optional services
For any cancellation, from the 30th day (for a stay in a Residence) or the 14th day (for a stay in a hotel or hotel apartment) prior to your stay, of the additional services invoiced (entertainment, restaurants, etc.), we retain €10 for each service cancelled by way of a cancellation charge.
4.3 - Non-appearance at holiday venue
If you do not turn up at your holiday venue, we will retain the administration charge initially paid and the premiums for any insurance policies taken out plus the following:
4.3.1 - Accommodation
a) Holiday in a Residence (PIERRE ET VACANCES/MAEVA/Deauville Residence): 100% of the total value of the holiday.
b) Holiday in a hotel (PIERRE ET VACANCES/MAEVA/LATITUDES HOTELS (except as specified at c) below)
• Accommodation only:
1 to 3 nights payment for one night*
4 to 6 nights payment for two nights*
7 nights or more payment for three nights*
* the price of a “night” is the total cost of the stay divided by the number of nights booked.
• Half-board or full board holiday:
The charges will be the same as above.
c) For LATITUDES HOTELS: holiday in a hotel or hotel apartment for the Pont Royal, Cap Esterel and Valescure hotels during the months of July and August 2009
- 100 % of the total amount of the package and transport.
4.3.2 - Optional services
You will not receive any refund for not using any booked and invoiced services at your holiday venue. We advise you to take out one of the insurance deals with Europ assistance (see Article 15 - Insurance). The premium must be paid in full at the time of booking and is not refundable in any circumstances.
ARTICLE 5 - ARRIVAL AND DEPARTURE
P&V draws your attention to the fact that failing full payment even after reminders have been issued, you will not be given the keys to accommodation if you present yourself at your holiday destination.
For PIERRE ET VACANCES and MAEVA
Keys are issued from 5pm on the day of your arrival provided the said payment has been made. These keys must be handed in by 10am on the day of your departure (Saturday in most cases). For short stays, keys are available from 2pm (PIERRE ET VACANCES sites and MGM RESIDENCES) or 11 o’clock (MAEVA sites), provided the said payment has been made; they must be handed in before 12 noon (PIERRE ET VACANCES sites and MGM RESIDENCES) or 6 p.m. (MAEVA sites) on the day of departure.
For LATITUDES HOTELS:
P&V draws your attention to the fact that failing full payment even after reminders have been issued, you will not be given the keys to accommodation if you present yourself at your holiday destination. Keys are issued: for seaside sites from 2pm or 5pm (depending on the sites), and for mountain sites from 5pm, on the day of your arrival, subject to the said payment. These keys must be handed in at seaside sites by 10am or 12 noon (depending on the sites), and at mountain sites by 10am, on the day of your departure. After this time you will be charged for an extra night.
NB: If due to major unforeseen events you cannot arrive at the set time, you must inform the Residence (or hotel) in order to get the access codes in some cases. They will then make arrangements directly with you so that you can obtain the keys to your apartment when you arrive.
ARTICLE 6 - DEPOSIT
A deposit of:
€200 per apartment, room, villa or house will be required on your arrival for PIERRE ET VACANCES and MAEVA residences; This will be returned to you at the end of your holiday after you have paid for any additional services used on site (telephone, car park, etc.) less any compensation deducted for any damage caused.
ARTICLE 7 - PETS
Pets are accepted in most of our residences, on presentation of an anti-rabies certificate, for the following fixed prices, payable locally: Pets are allowed in most of our residences, on presentation of a rabies vaccination certificate, subject to payment on site of the following charges:
PIERRE ET VACANCES:
For holidays of 7 nights or more, €49 per pet per holiday
For holidays of less than 7 nights, €8 per pet per night
For stays in hotels, €11 per pet per night
Pets are not allowed in residences in Spain or Italy.
LATITUDES HOTELS:
For stays in hotels, €11 per pet per night
For the Deauville Residence:
• for holidays of 7 nights or more, €49 per pet per holiday;
• for holidays of less than 7 nights, €8 per pet per night
For MAEVA:
Fixed fee of €47 (depending on the Residences) per pet, per week or holiday, to be paid on booking or on site on your arrival (the residences concerned are listed in this catalogue). They are permitted, on a lead, in the communal sections, but are forbidden around swimming pools. We regret to inform you that animals are not admitted to our hotels, except in exceptional circumstances (please ask us).
ARTICLE 8 - BYE-LAWS (PIERRE ET VACANCES / MAEVA)
In order to facilitate the smooth running of your holiday, bye-laws are posted in each apartment, room and house; please acquaint yourself with them and adhere to them. Certain precautions can prevent possible problems: close your picture windows before leaving your apartment, room or house and lock the door. We remind you that the P&V cannot be held liable for the loss of personal belongings left in your apartment, room or house when you vacate them.
ARTICLE 9 - FORMALITES CONCERNING TRANSPORT OR TRAVEL ABROAD
Special requirements of PIERRE ET VACANCES and MAEVA:
For these holidays including travel, each passenger must have a currently valid identity card or passport. We advise you to check the validity of the identity cards or passports of all members of the party (adults/children/infants), your insurance, and for holidays abroad, currency exchange regulations and any necessary vaccinations. Premature departure will not constitute entitlement to any refund.
• Minors travelling alone: in order to travel abroad, in addition to their valid identity card or passport, minors must have an official authorisation to leave the country signed by their parents or guardians.
• Foreign nationals or holders of travel documents: you must enquire with the consulates of each country about any necessary visas. The occupancy of accommodation will depend on flight times serving airports close to our Residences.
ARTICLE 10 - EARLY DEPARTURE / EARLY END TO SPORTS OR LEISURE ACTIVITIES
Early departure or early end to sports or leisure activities booked with P&V does not give any entitlement to reimbursement from them. However, depending on the package available with the Europ Assistance policy (see article 15), depending on the cause of departure from the site or termination of the activity being duly proven and falling within the terms of the policy, you may benefit from reimbursement on a pro rata basis, from the date of your departure from the site or the day of termination of the activity. With respect to early departure, you may benefit from pro rata reimbursement of the holiday only if you have fully vacated your apartment or room.
ARTICLE 11 - CHANGES TO OUR PROGRAMMES
If circumstances compel us, and only in circumstances of force majeure, outside our control, we may be obliged to change all or some of our programmes (total or partial closure of a site or a communal facility such as a swimming pool, restaurant, etc.). In the case of holidays including transport, you will be informed of the times and routes, types of train, plane or boat, subject to last-minute changes. Delays are sometimes inevitable (overcrowded airports, increase in air or rail traffic, strikes, bad weather conditions, etc.). You will be informed of any such circumstances as soon as possible
ARTICLE 12 - AFTER SALES SERVICE
Our on-site teams are at your disposal during your holiday to respond to your complaints, resolve any problems and enable you to enjoy your holiday to the full. Simply contact them with any requests. After your holiday, any claim should be made:
• by registered letter with acknowledgement of receipt, sent to Groupe Pierre & Vacances - Service Relations Clientèle - 11, rue de Cambrai - 75947 Paris Cedex 19 France.
• by e-mail to: relations.client@pierre-vacances.fr within two months of the end of your holiday so that we can deal with it as quickly as possible. We draw your attention to the fact that the longer you take to inform us of your claim, the more difficult it becomes to deal with it in your best interests. In your letter, please specify the name of the person who booked the holiday, the booking number, the place and dates of your holiday and the type of apartment or room booked in order to facilitate the processing of your claim. Please also enclose all documentary evidence to enable us to process your claim as quickly as possible: certificate issued by the site and/or personal documents (certificate of non-use of services, certificate of premature departure, hospitalisation report, etc.).
ARTICLE 13 - CATALOGUE
Booking one of our holidays implies acceptance of our particular terms and conditions of sale. General descriptions and photos of apartments are provided for informational purposes only. Given the diversity of the P&V range, there are differences in the layout and decoration of certain apartments and rooms. In our catalogue and on our website, we give you a general description of our apartments, sectional drawings, photographs and virtual visits, for information purposes.
For further details, please do not hesitate to ask your travel agent. We would also remind you that any request for a specific apartment location or orientation is an additional service and does not constitute a contractual guarantee.
All information on sporting and leisure activities at the resorts and surrounding area is supplied to us by tourist offices and is passed on to you by way of indication. We cannot be held liable if any of these facilities are no longer available at the time of your holiday. For further information on the facilities of the resorts, please contact their respective tourist offices directly. As our catalogue is printed well in advance, please ask your travel agent about opening dates, sports facilities (type and quantity), activities and services offered by the site which determine your choice of site. Furthermore, we cannot be held responsible for works undertaken by individuals or local authorities which might inconvenience our customers in the resorts or towns.
ARTICLE 14 - RESPONSIBILITY - LIABILITY
• We would draw to your attention the fact that renting a holiday apartment does not fall within the framework of hoteliers’ liability. Consequently, P&V cannot be held liable in the event of the loss or theft of or damage to personal effects in our Residences, apartments, car parks or communal areas (bicycle shed, etc.)
• Please note that the liability of hotel operators for the rental of accommodation in the hotels is governed by the French Civil Code. The hotel operator can therefore be held liable only within the legal limits in the event of loss, theft or damage to personal belongings in their rooms, car parks or communal facilities (ski sheds, cycle garages, etc).
• Provision for amounts due to P&V is not included in the field of application of the hotel statute (article 2272 of the Civil Code). In exception to Article 2244 of the Civil Code, the sending of a registered letter by P&V to any client-debtor interrupts the statute applicable in such a case.
ARTICLE 15 - INSURANCE
We have contracted the policy No. 53 789 536 M from Générali Assurances / Europ Assistance for you, comprising different formulas to which you may subscribe. This insurance takes effect from the day of your P&V reservation or the following day at midday after payment of the premium if subscription takes place after reservation. It must be taken out before the beginning of cancellation costs. Important: Under the terms of this contract, legal or tax residents of the European Union, Andorra, Gibraltar, Liechtenstein, Monaco, Norway, San Marino, and Switzerland are insured.

Particular terms and conditions of sale
ARTICLE 1 - REGISTRATION / BOOKING / PAYMENT
1.1- Registration and booking terms and conditions
Every registration must be accompanied by a payment including:
The administration charge:
- Tor online bookings (PIERRE & VACANCES/MAEVA): €20 per booking for any stay of 5 nights or more, €10 per booking for any stay of 4 nights or less);
- For other bookings (PIERRE & VACANCES/MAEVA/RESIDENCES MGM): an administration charge of €26 per booking for any stay of 5 nights or more, €13 per booking for any stay of 4 nights or less;
NB: you will not be asked for any administrative fees for bookings made in Adagio City Aparthotels and LATITUDES HOTELS.
A deposit corresponding to:
- 25% of the overall price of your booking and any additional services, whether included or not, in particular meals, children’s clubs, sporting activities, etc.
- 100% of the overall price of any transport services (flights, transfer, car hire, rail travel),
- 100% of the value of insurance premiums if you want to take out the insurance.
For MAEVA/PIERRE & VACANCES packages (air transport + accommodation), every registration must be accompanied by a payment including:
The administration charge: an administration charge of €26 per booking for any stay of 5 nights or more, €13 per booking for any stay of 4 nights or less);
A deposit corresponding to:
- 25% of the overall price of your accommodation, transport and any additional services whether inclusive or separately booked (meals, children's clubs, sports tuition, etc.)
- 100% of the value of insurance premiums if you want to take out the insurance.
1.2 - Premium facility
From the date of payment of fees and advances up to the 31st day (for a stay in a tourist residence) or the 15th day (for a stay in a hotel or hotel apartment) inclusive preceding your stay, you will benefit from a premium facility. If you exercise it, the deposit paid will be refunded to you but the above mentioned administration charge will be retained by P&V. The total amount of insurance is payable upon reservation and cannot be reimbursed.
1.3 - Payment of the balance
The full price of your booking plus any additional services is payable:
- 30 days before the start of your holiday in a tourist residence
- 14 days before the start of your holiday in a hotel or hotel apartment
- or in all cases immediately for any last minute reservations.
The full price must have been paid, before you are sent your travel documents (including your rental contract or accommodation slip, description of the location, plane tickets, etc.) by P&V.
If you have not settled the account within the specified timeframe and you have not used your premium facility, P&V reserves the possibility to consider the sale as definitive from either the 30th day or the 14th day before your stay depending on your reservation and may apply the cancellation conditions drawn up for this event and defined hereafter as a consequence. Your commitment therefore become final on payment of the balance before the 30th or 14th day of your stay or, in the event of non-payment of the balance and no use of the premium facility on your behalf, from the 30th or 14th day preceding your stay. P&V's commitment becomes final before the 30th or 14th day preceding your stay, from the sending of your reservation confirmation.
1.4 - Methods of Payment
For PIERRE ET VACANCES / MAEVA / RESIDENCES MGM
For all bookings up to 31 days before your holiday, you may pay 100% of the cost of your holiday by any method of payment: bank card (*), cheque (**), or bank transfer (***)
For all bookings between 30 and 15 days prior to your holiday, you may:
- pay 100% of the cost of your holiday by bank card (*)
- or pay 25% of the cost of the holiday as a deposit by bank card (*) and the balance within 5 days by cheque (**) or bank transfer (***).
For all bookings between 14 and 8 days prior to your holiday, you may:
- pay 100% of the cost of your holiday by bank card (*)
- or pay 50% of the cost of the holiday as a deposit by bank card (*) and the balance within 5 days by cheque (**) or bank transfer (***).
For all bookings made less than 7 days prior to the beginning of the holiday, you must pay 100% of the cost of your holiday by bank card only (*).
For LATITUDES HOTELS
Payments may be made by bank card (*), cheque (**) or bank transfer (***). For any reservation less than 15 days before the start of the stay, payment is only possible by bank card.

ARTICLE 2 - PRICES
2.1 - Accommodation
Our prices include all taxes and include the provision of the accommodation, including charges (water, electricity, heating) but excluding tourist tax, payable on site, pet supplements, optional insurance premiums and administration charges, payable on booking where applicable. We would remind you that accommodation provided for a specific number of occupants on booking may not be occupied by a larger number of people.
For MAEVA: It is reminded that young children are considered as occupying a complete space. Some of our balconies, loggias, terraces and gardens are not equipped with tables and chairs.
2.2 - Package deals (air transport + accommodation) (Valid only for PIERRE & VACANCES / MAEVA)
Our prices are valid subject to availability on scheduled or charter flights (the price depends on the date of departure); they are fully inclusive of tax (except for special taxes such as airport and security taxes, passenger fees), they include transport services on scheduled or charter flights from Paris (a surcharge applies for departures from provincial airports), provision of accommodation, including charges (water, electricity, heating) except for: administrative charges, where applicable, resort tax, transfer costs, additional optional services, pet charges and insurance premiums, and single room surcharge for hotels. For transport, you may be offered special rates depending on the terms and conditions and availabilities at the time of booking and the economic situation at that time. Changes to the economic situation compared to that at the time of publication may include the following:
- changes in the fares themselves (due to fuel prices, extra costs invoiced, etc.)
- price supplements which P&V may have to charge in the event of additional commitments arising mid-season due to the exhaustion of stocks originally on offer before your booking.
2.3 - Optional Services
Our accommodation rates do not include optional extra services on offer in the catalogue, on our website or on site.
Special case for transport service
Our prices are valid subject to the availability of the means of transport (the price depends on the date of departure); they are fully inclusive of tax (except for special taxes such as airport and security taxes, passenger fees), they include transport services on scheduled or charter flights from Paris (a surcharge applies for departures from provincial airports), except for: administrative charges, where applicable, resort tax, transfer costs and insurance premiums. You may be offered special rates depending on the terms and conditions and availabilities at the time of booking and the economic situation at that time. Changes to the economic situation compared to that at the time of publication may include the following:
- changes in the fares themselves (due to fuel prices, extra costs invoiced, etc.)
- price supplements which P&V may have to charge in the event of additional commitments arising mid-season due to the exhaustion of stocks originally on offer before your booking.
2.4 – Snow guarantee (Valid only for PIERRE & VACANCES / MAEVA)
2.4.1 – What the insurance covers
Our prices include insurance for cancellation of the holiday in the event of a lack or excess of snow, if all of the following three conditions are met:
1) the lack or excess of snow occurs in a ski area located above 1200 metres altitude
2) the departure is between the 3rd Saturday in December and the 2nd Saturday in April
3) the lack or excess of snow entails the closure of over 2/3 of the ski lifts normally in service on your holiday site, for at least 2 consecutive days, within the 5 days preceding your departure.
Important: Under the terms of this contract, legal or tax residents of the European Union, Andorra, Gibraltar, Liechtenstein, Monaco, Norway, San Marino, Switzerland, the French overseas départements and French Polynesia are insured.
2.4.2 – How to make the claim
You must inform P&V of your cancellation, then contact Europ Assistance within five working days of the event covered by the guarantee. To do this you must send Europ Assistance a cancellation declaration (including the insurance policy number: 63.112.088.V) by post to Europ Assistance – Sinistres Assurance Voyages – 1 promenade de la Bonnette – 92633 GENNEVILLIERS Cedex France, by fax to (00 33) (0)1 41 85 85 61 or by e-mail to
slv@europ-assistance.fr. Europ Assistance will send you a file to complete including a list of documents to be supplied, including documentation confirming the lack or excess of snow and the original cancellation invoice issued by P&V.
2.4.3 - Amount of refunds
EUROP ASSISTANCE will refund the deposits or any amounts kept by P&V, except any administrative charges originally paid. The refund is paid minus the specific deductibles shown in the following Guarantee Amount Table. The guarantee is granted provided that the rental accommodation is fully vacated. All of the tourist services covered by the "Snow Guarantee" insurance, whether they be additional or successive, constitute a single holiday, for which only one date of departure is taken into account: the date given by P&V for the beginning of the services insured.

2.5 – Reduction (Valid only for PIERRE ETVACANCES / MAEVA)
The reductions mentioned in the catalogue are only applicable to accommodation and therefore all other services (meals, sport and leisure activities, etc.) are excluded.
2.6 - Revised travel prices
The prices shown in our catalogue have been set according to the following economic data (on May 15 2008):
- the cost of transport depending on the fuel costs
- fees and taxes pertaining to the services provided, such as landing, boarding or disembarkation taxes in ports and airports.
The date mentioned above determines the above economic data used to set the prices published in the P&V Catalogue. In the event of change to any of this data, P&V reserves the right to alter its sales prices, passing on all the said changes directly to its prices. In accordance with legislation in force and for P&V guests already booked, no changes will be made to prices less than 30 days before their departure.
ARTICLE 3 - TOURIST TAX
Tourist tax, collected on behalf of the local authorities, is not included in our prices. It is approximately €1 per person per day and should be paid on site.
ARTICLE 4 - ALTERATION / CANCELLATION OF HOLIDAY BY THE CUSTOMER
4.1 - Alteration
4.1.1 – Accommodation
a) For LATITUDES HOTELS
For any hotel stay of three nights or less, we will endeavour to accept your requests to change the date, type of accommodation or holiday venue as far as possible subject to availability. These alterations may be made at no additional cost.
For any hotel stay of three nights or less, we will also endeavour to accept your requests to change the date, type of accommodation or holiday venue as far as possible subject to availability. If the value of your booking (excluding optional services) after the alteration is lower than the value of the booking before the alteration, we will retain €10 as a charge for this alteration.
b) For RESIDENCES MGM / MAEVA / PIERRE ET VACANCES
Change of type
We will endeavour to accept your requests to change the type of apartment as far as possible subject to availability. If the value of your booking (excluding optional services) after the alteration is lower than the value of the booking before the alteration, we will retain €10 as a charge for this alteration.
Change of holiday date or place
We will endeavour to accept your requests to change the date or holiday venue as far as possible subject to availability. However, please note that this type of change causes variable costs for P&V depending on the date on which you make your request.
This means that for all changes of holiday date or place, we will apply the following charges:
- if your request to change is made within 30 days prior to your arrival: the amount of any administrative charge originally paid and the amount of any insurance premiums taken.
- if your request to change is made between 30 and 15 days prior to your arrival: 15% *
- if your request to change is made between 14 and 8 days prior to your arrival: 30% *
- if your request to change is made between 7 and 4 days prior to your arrival: 50% *
* of the total cost of the accommodation.
No request to change will be taken into account if it is received by P&V three days or less prior to your arrival.
NB:
- any request to extend the length of your holiday will be accepted by P&V without any additional charge
- any request to reduce the length of your holiday will be deemed by P&V to be a partial cancellation and will be subject to the cancellation terms referred to in 4.2 hereafter.
4.1.2 - Package deals (air transport + accommodation)
a) For MAEVA / PIERRE ET VACANCES (except West Indies)
Changes to outward or return travel dates are either impossible or will incur variable costs for the passenger depending on the date upon which the change occurs and according to the terms and conditions mentioned at the time of booking.
We will endeavour to accept your requests to change the date or holiday venue as far as possible subject to availability. However, please note that this type of change causes variable costs for P&V depending on the date on which you make your request. Therefore for all changes of holiday date or place, we will apply the following charges:
- if your request to change is made within 30 days prior to your arrival the amount of the administrative charge originally paid, the amount of any insurance premiums taken out and €60 per return ticket for flight cancellation costs.
- if your request to change is made between 30 and 15 days prior to your arrival: 15% *
- if your request to change is made between 14 and 8 days prior to your arrival: 30% *
- if your request to change is made between 7 and 4 days prior to your arrival: 50% *
* of the total cost of the accommodation and transport
No request to change will be taken into account if it is received by P&V three days or less prior to your arrival.
NB:
- any request to extend the length of your holiday will be accepted by P&V without any additional charge
- any request to reduce the length of your holiday will be deemed by P&V to be a partial cancellation and will be subject to the cancellation terms referred to in 4.2 hereafter.
b) For PIERRE ET VACANCES - Antilles
We will endeavour to accept your requests to change the date or holiday venue as far as possible subject to availability. However, please note that this type of change causes variable costs for P&V depending on the date on which you make your request. Therefore for all changes of holiday date or place, we will apply the following charges:
- if your request to change is made within 30 days prior to your arrival: the amount of any administrative charge originally paid plus the amount of any insurance premiums contracted, €100 per return ticket for the cancellation of flights.
- if your request to change is made between 30 and 15 days prior to your arrival: 15% of the total cost of the accommodation + 50% of the total cost of transport
- if your request to change is made between 14 and 8 days prior to your arrival: 30% of the total cost of the accommodation + 50% of the total cost of transport
- if your request to change is made between 7 and 4 days prior to your arrival: 50% of the total cost of the accommodation + 100% of the total cost of transport
No request to change accommodation will be taken into account if it is received by P&V three days or less prior to your arrival.
NB:
- any request to extend the length of your holiday will be accepted by P&V without any additional charge
- any request to reduce the length of your holiday will be deemed by P&V to be a partial cancellation and will be subject to the cancellation terms referred to in 4.2 hereafter.
4.1.3 – Optional services
We will endeavour to accept your requests to change the optional services as far as possible subject to availability. If the value of your optional service after the alteration is lower than the value of the optional service before the alteration, we will retain €10 as a charge for this alteration. With respect to transport, whatever the means of transport and date, changes to outward or return travel dates are either impossible or will incur variable costs for the passenger depending on the date upon which the change occurs and according to the terms and conditions mentioned at the time of booking.
For LATITUDES HOTELS
For all stays of three nights or less, we will endeavour whenever possible to accept your requests for change of optional services subject to availability. These changes may be made without any surcharge.
For all stays in hotels of over three nights, we will also endeavour whenever possible to accept your requests for changes in optional services subject to availability. If the amount of your optional service after the changes proves to be less than the amount of the optional service before the changes, we will retain €10 as a charge for these changes.
4.2 – Cancellation (total or partial)
In the event of cancellation you must notify us either by post to the following address PIERRE ET VACANCES service annulations BP291 75921 PARIS CEDEX 19, or by fax 33 ( 01) 58 21 50 97 for the attention of "service annulations", or by e-mail to the following address:
annulation.adv@pierre-vacances.fr. The date of cancellation is determined by the date of receipt of notification.
4.2.1 - Accommodation
a) Holiday in a Residence (PIERRE ET VAVANCES / MAEVA / RESIDENCES MGM / Deauville Residence)
If you advise us before the 30th day prior to your holiday, we will retain the administration charge initially paid and the premiums for any insurance policies taken out.
If you advise us after the 30th day prior to your holiday, we will retain the administration charge initially paid and the premiums for any insurance policies taken out plus the following percentages depending on the type of holiday booked:
- between 30 and 15 days prior to your arrival: 25% *
- between 14 and 8 days prior to your arrival: 50% *
- 7 days or less prior to your arrival: 100% *
* of the total cost of the accommodation.
b) Holiday in a hotel or hotel apartment (PIERRE & VACANCES / MAEVA / LATITUDES HOTELS (except as specified at c) below)
For any stay of three nights or less which is cancelled before 4 p.m. on the date of arrival, we will only retain the insurance premiums.
For any stay of more than three nights, if you advise us after the 14th day prior to your holiday and before 4 p.m. on the date of arrival, we will retain the insurance premiums initially paid plus the following depending on the type of holiday booked:
- 4 - 6 nights = payment for one night
- 7 nights or more = payment for two nights
- Half-board or full board holiday: the charges will be the same as above.
c) Special case for LATITUDES HOTELS: holiday in a hotel or hotel apartment in the mountains during the French school holidays
If you inform us before the 14th day prior to your holiday, we will retain the amount of any insurance premiums paid.
If you inform us after the 14th day prior to your holiday, we will retain the amount of any insurance premiums paid, plus the following fees according to the type of your holiday:
- between 14 and 8 days prior to your arrival: 50% of the total cost of the accommodation
- 7 days or less prior to your arrival: 100% of the total cost of the accommodation
4.2.2 – Package deals (air transport + accommodation) (PIERRE ET VACANCES except West Indies / MAEVA)
a) PIERRE ET VACANCES except West Indies / MAEVA
If you advise us before the 30th day prior to your holiday, we will retain the administration charge initially paid and the premiums for any insurance policies taken out and
- €100 per return ticket issued for cancellation of seats on scheduled flights
- no cancellation charge for cancellation of seats on charter flights.
If you advise us after the 30th day prior to your holiday, we will retain the administration charge initially paid and the premiums for any insurance policies taken out plus the following percentages:
For a package including flight (charter) and accommodation:
- between 30 and 15 days prior to your arrival: 25% of accommodation + 100% of transport costs
- between 14 and 8 days prior to your arrival: 50% of accommodation + 100% of transport costs
- 7 days or less prior to your arrival: 100% of accommodation + 100% of transport costs
For a package including flight (scheduled) and accommodation:
- between 30 and 15 days prior to your arrival: 25% of the total cost of the package
- between 14 and 8 days prior to your arrival: 50% of the total cost of the package
- 7 days or less prior to your arrival: 100% of the total cost of the package
b) PIERRE ET VACANCES West Indies
If you inform us before the 30th day prior to your holiday, we will keep the administrative charge, if applicable, originally paid, the amount of any insurance premiums taken out and €200 per return ticket for flight cancellation costs.
If you advise us after the 30th day prior to your holiday, we will retain the administration charge initially paid and the premiums for any insurance policies taken out plus the following percentages:
- between 30 and 15 days prior to your arrival: 25% of accommodation and 50% of transport costs
- between 14 and 8 days prior to your arrival: 50% of accommodation and 50% of transport costs
- 7 days or less prior to your arrival: 100% of the total accommodation and transport costs
4.2.3 – Optional services
For any additional services invoiced (activities, meals, etc.) cancelled after the 30th day (for a holiday in a residence) or 14th day (for a holiday in a hotel or hotel apartment) preceding your holiday, we will retain €10 per cancelled service for cancellation costs.
Special case (1): for any cancellation of an ESF ski lesson between D-4 and the date of arrival (for arrivals on a Saturday), we will retain 100% of the cost of the service.
Special case (2): the entrance ticket for Parc Disneyland® and Parc Walt Disney Studios® is non-reimbursable.
Special case (3): Transport = Whatever the means of transport, cancellation by the customer incurs payment by them of variable costs depending on the date of cancellation and the terms and conditions specified at the time of booking.
4.3 - Non-appearance at holiday venue
If you do not turn up at your holiday venue, we will retain the administration charge initially paid and the premiums for any insurance policies taken out plus the following:
4.3.1 - Accommodation
a) Holiday in a Residence (PIERRE ET VAVANCES / MAEVA / RESIDENCES MGM / Deauville Residence)
- 100% of the total value of the holiday.
b) Holiday in a hotel (PIERRE ET VACANCES / MAEVA / LATITUDES HOTELS (except as specified at c) below)
Accommodation only:
1 to 3 nights = payment for one night
4 to 6 nights = payment for two nights
7 nights or more= payment for three nights
Half-board or full board holiday:
The charges will be the same as above.
c) For LATITUDES HOTELS: holiday in a hotel or hotel apartment in the mountains during the French school holidays
If you inform us before the 14th day prior to your holiday, we will retain the amount of any insurance premiums paid.
If you inform us after the 14th day prior to your holiday, we will retain the amount of any insurance premiums paid, plus the following fees according to the type of your holiday:
- between 14 and 8 days prior to your arrival: 50% *
- 7 days or less prior to your arrival: 100% *
* of the total cost of the accommodation.
4.3.2 – Package deals (air transport + accommodation) and transport
- 100% of the total amount of the package or transport.
4.3.3 – Optional services
You will not receive any refund for not using any booked and invoiced services at your holiday venue. We advise you to take out one of the insurance deals with Europ assistance (see Article 16 - Insurance). The premium must be paid in full at the time of booking and is not refundable in any circumstances.
ARTICLE 5 - TRANSPORT (PIERRE ET VACANCES / MAEVA)
- Times / delays: you will be informed of times and routes, types of aircraft, subject to last-minute changes. P&V cannot be held liable for any independent events or force majeure circumstances, affecting the intensity of traffic or its punctuality. We therefore advise you not to plan any important commitments the day before departure or the day following your return.
- Length of travel: If due to travel times, the first and/or last day are shortened, no repayment will be made.
Particular note with respect to air transport
In compliance with decree no. 2006-315 of 17/03/06, P&V undertakes to keep you informed as to the identity of the travel company in charge of the flight(s) concerned. The main travel companies engaged by the P&V are as follows:
- for PIERRE ET VACANCES: Italy = Air France and Alitalia; Spain = Air France, Iberia and Air Europa; West Indies = Air France
- for MAEVA: Tunisia = Air Méditerranée, Tunisair, Air France; Spain = Air France, Air Europa, Iberia.
P&V may also propose charter flights.
P&V undertakes, at the latest 8 (eight) days prior to your departure, or at the time of full payment of your booking if this is made within 8 (eight) days of your departure, to confirm the identity of the actual travel company operating the flight(s) concerned.
ARTICLE 6 - ARRIVAL AND DEPARTURE
P&V draws your attention to the fact that failing full payment even after reminders have been issued, you will not be given the keys to accommodation if you present yourself at your holiday destination.
For PIERRE ET VACANCES, RESIDENCES MGM and MAEVA:
Keys are issued from 5pm on the day of your arrival provided the said payment has been made. These keys must be handed in by 10am on the day of your departure (Saturday in most cases). For short stays, keys are available from 2 p.m. and must be returned before 12 noon on the day of departure.
For LATITUDES HOTELS:
P&V draws your attention to the fact that failing full payment even after reminders have been issued, you will not be given the keys to accommodation if you present yourself at your holiday destination. Keys are issued: for seaside sites from 2pm or 5pm (depending on the sites), and for mountain sites from 5pm, on the day of your arrival, subject to the said payment. These keys must be handed in at seaside sites by 10am or 12 noon (depending on the sites), and at mountain sites by 10am, on the day of your departure. After this time you will be charged for an extra night.
NB:
If due to major unforeseen events you cannot arrive at the set time, you must inform the Residence (or hotel) in order to get the access codes in some cases. They will then make arrangements directly with you so that you can obtain the keys to your apartment when you arrive.
ARTICLE 7 - DEPOSIT
A deposit of:
- €200 per apartment, room, villa or house will be required on your arrival for PIERRE ET VACANCES and MAEVA residences
- €300 per apartment or house will be required on your arrival for RESIDENCES MGM residences
This will be returned to you at the end of your holiday after you have paid for any additional services used on site (telephone, car park, etc.) less any compensation deducted for any damage caused.
ARTICLE 8 - PETS
Pets are accepted in most of our residences, on presentation of an anti-rabies certificate, for the following fixed prices, payable locally:
Pets are allowed in most of our residences, on presentation of a rabies vaccination certificate, subject to payment on site of the following charges:
For RESIDENCES MGM:
- For holidays of 7 nights or more, €50 per pet per holiday
- For holidays of less than 7 nights, €10 per pet per night
For PIERRE ET VACANCES:
- For holidays of 7 nights or more, €49 per pet per holiday
- For holidays of less than 7 nights, €8 per pet per night
- For stays in hotels, €11 per pet per night
Pets are not allowed in residences in Spain or Italy.
For LATITUDES HOTELS:
For stays in hotels, €11 per pet per night
For the Deauville Residence:
- for holidays of 7 nights or more, €49 per pet per holiday
- for holidays of less than 7 nights, €8 per pet per night
For MAEVA:
Fixed fee of €47 (depending on the Residences) per pet, per week or holiday, to be paid on booking or on site on your arrival (the residences concerned are listed in this catalogue). They are permitted, on a lead, in the communal sections, but are forbidden around swimming pools. We regret to inform you that animals are not admitted to our hotels, except in exceptional circumstances (please ask us).
ARTICLE 9 - BYE-LAWS (PIERRE ET VACANCES/MAEVA/RESIDENCES MGM)
In order to facilitate the smooth running of your holiday, bye-laws are posted in each apartment, room and house; please acquaint yourself with them and adhere to them. Certain precautions can prevent possible problems: close your picture windows before leaving your apartment, room or house and lock the door. We remind you that the P&V cannot be held liable for the loss of personal belongings left in your apartment, room or house when you vacate them.
ARTICLE 10 – FORMALITES CONCERNING TRANSPORT OR TRAVEL ABROAD
Special requirements of PIERRE ET VACANCES and MAEVA:
For these holidays including travel, each passenger must have a currently valid identity card or passport. We advise you to check the validity of the identity cards or passports of all members of the party (adults/children/infants), your insurance, and for holidays abroad, currency exchange regulations and any necessary vaccinations. Premature departure will not constitute entitlement to any refund.
- Minors travelling alone: in order to travel abroad, in addition to their valid identity card or passport, minors must have an official authorisation to leave the country signed by their parents or guardians.
- Foreign nationals or holders of travel documents: you must enquire with the consulates of each country about any necessary visas. The occupancy of accommodation will depend on flight times serving airports close to our Residences.
For holidays in Tunisia:
In compliance with Tunisian legislation, all foreigner adults wishing to travel to Tunisia must have a National Identity Card or a currently valid passport. All foreign minors must either have a currently valid individual identity card or be included on the passport of an accompanying parent or guardian. Minors with a different family name from that of their parent(s) are advised to carry a multilingual birth certificate specifying the details of their parents. Minors travelling alone or accompanied by unrelated third parties must have permission to leave the country.
ARTICLE 11 - EARLY DEPARTURE / EARLY END TO SPORTS OR LEISURE ACTIVITIES
Early departure or early end to sports or leisure activities booked with P&V does not give any entitlement to reimbursement from them. However, depending on the package available with the Europ Assistance policy (see article 16), depending on the cause of departure from the site or termination of the activity being duly proven and falling within the terms of the policy, you may benefit from reimbursement on a pro rata basis, from the date of your departure from the site or the day of termination of the activity. With respect to early departure, you may benefit from pro rata reimbursement of the holiday only if you have fully vacated your apartment or room.
ARTICLE 12 – CHANGES TO OUR PROGRAMMES
If circumstances compel us, and only in circumstances of force majeure, outside our control, we may be obliged to change all or some of our programmes (total or partial closure of a site or a communal facility such as a swimming pool, restaurant, etc.). In the case of holidays including transport, you will be informed of the times and routes, types of train, plane or boat, subject to last-minute changes. Delays are sometimes inevitable (overcrowded airports, increase in air or rail traffic, strikes, bad weather conditions, etc.). You will be informed of any such circumstances as soon as possible
ARTICLE 13 - AFTER SALES SERVICE
Our on-site teams are at your disposal during your holiday to respond to your complaints, resolve any problems and enable you to enjoy your holiday to the full. Simply contact them with any requests. After your holiday, any claim should be made:
- by registered letter with acknowledgement of receipt, sent to Groupe Pierre & Vacances - Service Relations Clientèle - 11, rue de Cambrai - 75947 Paris Cedex 19 France
- by e-mail to: relations.
client@pierre-vacances.fr within two months of the end of your holiday so that we can deal with it as quickly as possible. We draw your attention to the fact that the longer you take to inform us of your claim, the more difficult it becomes to deal with it in your best interests. In your letter, please specify the name of the person who booked the holiday, the booking number, the place and dates of your holiday and the type of apartment or room booked in order to facilitate the processing of your claim. Please also enclose all documentary evidence to enable us to process your claim as quickly as possible: certificate issued by the site and/or personal documents (certificate of non-use of services, certificate of premature departure, hospitalisation report, etc.).
ARTICLE 14 - CATALOGUE
Booking one of our holidays implies acceptance of our particular terms and conditions of sale. General descriptions and photos of apartments are provided for informational purposes only. Given the diversity of the P&V range, there are differences in the layout and decoration of certain apartments and rooms. For further details, please do not hesitate to ask your travel agent. We would also remind you that any request for a specific apartment location or orientation is an additional service and does not constitute a contractual guarantee. All information on sporting and leisure activities at the resorts and surrounding area is supplied to us by tourist offices and is passed on to you by way of indication. We cannot be held liable if any of these facilities are no longer available at the time of your holiday. For further information on the facilities of the resorts, please contact their respective tourist offices directly. As our catalogue is printed well in advance, please ask your travel agent about opening dates, sports facilities (type and quantity), activities and services offered by the site which determine your choice of site. Furthermore, we cannot be held responsible for works undertaken by individuals or local authorities which might inconvenience our customers in the resorts or towns.
ARTICLE 15 – RESPONSIBILITY - LIABILITY
- We would draw to your attention the fact that renting a holiday apartment does not fall within the framework of hoteliers’ liability. Consequently, P&V cannot be held liable in the event of the loss or theft of or damage to personal effects in our Residences, apartments, car parks or communal areas (bicycle shed, etc.)
- Please note that the liability of hotel operators for the rental of accommodation in the hotels is governed by the French Civil Code. The hotel operator can therefore be held liable only within the legal limits in the event of loss, theft or damage to personal belongings in their rooms, car parks or communal facilities (ski sheds, cycle garages, etc).
- Provision for amounts due to P&V is not included in the field of application of the hotel statute (article 2272 of the Civil Code). In exception to Article 2244 of the Civil Code, the sending of a registered letter by P&V to any client-debtor interrupts the statute applicable in such a case.
ARTICLE 16 - INSURANCE
We have contracted the policy No. 53 789 536 M from Générali Assurances / Europ Assistance for you, comprising different formulas to which you may subscribe. This insurance takes effect from the day of your P&V reservation or the following day at midday after payment of the premium if subscription takes place after reservation. It must be taken out before the beginning of cancellation costs.
Important: Under the terms of this contract, legal or tax residents of the European Union, Andorra, Gibraltar, Liechtenstein, Monaco, Norway, San Marino, and Switzerland are insured.
